Manufactured homes Province of British Columbia

If an executor submits a notice of transfer under subsection , at the same time the executor must submit a notice of the transfer from the executor to the beneficiary. If a notice of transfer is in relation to a transfer from an owner to a lessee owner, the name of both the owner and the lessee owner must be given on the notice. If the manufactured home is not registered with the Manufactured Home Registry (“MHR”), it may be difficult for you to ascertain whether the home is actually a manufactured home. You should start by looking at the BC Assessment roll report which, in the legal description, should indicate a MHR number, specifically if the owner used the status of the manufactured home to qualify for a CMHC-insured mortgage of the land and premises. If you aren't able to pay your property taxes by thedue date, you may be able to postpone paying your taxes.

$1.50, plus any tax imposed under the Part IX of the Excise Tax Act applicable to the operator fee, may be charged for any transaction done by electronic means from a location outside a government office or at a government office by a person who is not a government employee. In some instances, your client may have the appropriate electrical certification sticker and have the home registered with the Manufactured Home Registry. You still must confirm that no alterations to the electrical wiring has been done without permit since the original certification was granted. Alterations without permit would render the certification invalid and a new inspection would be required.

A list of accredited inspection bodies is provided on the Technical Safety BC website. The most common approval marks found in manufactured homes are Silver Labels provided by Technical Safety BC or CSA stickers. These are typically affixed to the electrical panel of the manufactured home and may appear next to the manufactured home registration sticker.

This can result in an increase in the rent payable, and there is no restriction to how much that increase may be. You must also be aware of “dummy numbers” issued by BC Assessment when they are assessing properties and observe a manufactured home on the land that do not have a MHR number. These dummy numbers are indicated by an alphanumeric entry beginning with an A, B or Z, and do not mean that the manufactured home has been de-registered. They are, however, are a good indication that the manufactured home was likely built prior to April 1, 1978 and has remained on the property since then. As such, the manufactured home has likely never been registered with the Manufactured Home Registry and may not meet CSA standards. Information on mandatory electrical inspections and labels can be found in the Electrical Safety Regulations which are part of the Safety Standards Act that are enforced in B.C.

You must ensure that the sticker is present before agreeing to list a manufactured home for sale. If your client indicates that the sticker was lost, deteriorated and fell off, or even if the home was built before the inspection labels were required, you must advise them of the need for an inspection and the application of a new label. You cannot act for a seller if they are not willing to have an inspection done. This information is intended for use by real estate professionals, to support their understanding of the standards they must meet in the delivery of real estate services. The Personal Property Registry records security interests and liens against personal property belonging to British Columbia businesses and individuals.

Any attempt to avoid or contract out of this Act or the regulations is of no effect. When a homeowner assigns a lease to the buyer of the home, the tenancy agreement continues on the same terms, including the rent, as existed before the assignment. The buyer becomes the tenant of the park owner and takes on the rights and responsibilities arising under the Manufactured Home Park Tenancy Act and the tenancy agreement.

This error may result in late payment penalties and interest charges. The park owner may only withhold consent for one of the permitted grounds set out in the regulation. The Manufactured Home Park Tenancy Regulation sets out an orderly process for assigning and subletting manufactured home pad tenancy agreements.

Sometimes consumers may be unaware that their manufactured home is not compliant with provincial legislation and sometimes they are aware but wish to proceed with the transaction. If your client is unwilling to bring their manufactured home into compliance with the Manufactured Home Act and Safety Standards Act, the manufactured home cannot be listed for sale or sold. If you want to move your manufactured home after May 31, you must pay all taxes before a tax clearance certificate is issued. In addition to the Regulation, the Manufactured Home Park Tenancy Act allows arbitrators to order an assignment or sublet if the park owner withheld consent unreasonably or arbitrarily or for a reason not permitted by the Regulation. Offer essential products or services like housing, food or health care. New homes not found on this registry or by calling the Licensing & Consumer Services Branch will be treated as potentially non-compliant and may not be sold until approved by BC Housing.
